Introduction

Welcome to AliBacklink! These Terms of Service (“Terms”) govern your access to and use of AliBacklink’s digital marketing services (the “Services”). AliBacklink (“we”, “us”, or “our”) is a digital marketing service provider based in Germany and serving users worldwide. By purchasing or using our Services, you (the “User” or “you”) agree to be bound by these Terms, as well as our Privacy Policy (described below) and any applicable laws and regulations. If you do not agree with these Terms, you should not use our Services.

These Terms describe your rights and responsibilities and form a legally binding agreement between you and AliBacklink. We strongly advise you to read this document carefully. If you have any questions about these Terms, please contact us before using the Services.


User Eligibility

  • Age Requirement: You must be at least 18 years old to purchase or use our Services. By placing an order or creating an account, you represent and warrant that you are 18 or older and legally capable of entering into binding contracts. If you are under 18, you are not permitted to use AliBacklink’s Services.

  • Business Use: If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, and in that case “you” will refer to both you as an individual and the entity you represent.

  • Compliance with Laws: You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations. You may not use AliBacklink if you are in a jurisdiction where providing or using our Services would violate any law or regulation.

  • Account Security: You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You agree to provide accurate and truthful information when creating an account or placing an order, and to update this information as necessary.

Services Provided

AliBacklink offers professional digital marketing services focused on enhancing your online presence. Our Services include:

  • One-Time Digital Marketing Services: These are individual services (such as SEO optimization, backlink building, content marketing campaigns, etc.) that you can purchase on a one-time basis. Each one-time service is delivered within an estimated timeframe of 7 to 14 days from the date of purchase, assuming all necessary inputs (e.g. information or materials from you) are provided promptly.

  • Subscription-Based Services (“AliBacklink Pro”): We offer recurring subscription plans (described in the next section) which provide ongoing digital marketing services on a monthly basis. Subscribers to AliBacklink Pro are entitled to place a certain number of service orders concurrently and benefit from expedited delivery times as outlined in their chosen plan.

We will use reasonable skill and care in delivering our Services. However, you acknowledge that digital marketing outcomes (such as search engine rankings or traffic increases) depend on many factors beyond our control (e.g., search engine algorithms, market conditions), and therefore AliBacklink does not guarantee specific results or success metrics. All Services are provided on an “as is” basis without warranties as to any specific outcomes. In particular, AliBacklink makes no representations or warranties about the suitability, reliability, timeliness, security, or accuracy of our Services, and we do not guarantee continuous or uninterrupted availability of the Service.

We reserve the right to modify or discontinue any part of the Services (or the scope of particular service offerings) at any time. We will endeavor to notify users of any major changes to service offerings that might affect existing orders or subscriptions.

Subscription Plans

AliBacklink Pro is an optional subscription-based service for users who require ongoing digital marketing support. We offer three tiered monthly plans, each with different levels of service:

  1. Pro Tier 1 – $199/month: Allows you to have one service order in progress at any given time. Once the active order is completed and delivered, you may place your next order. Each order under Tier 1 will be delivered within approximately 7 days.

  2. Pro Tier 2 – $499/month: Allows up to two service orders to be in progress concurrently. You can submit two orders simultaneously, and each will be delivered within approximately 7 days.

  3. Pro Tier 3 – $1199/month: Allows up to three service orders to be in progress concurrently. This tier offers expedited delivery with each order delivered within approximately 3 days.

Subscription Term and Renewal: All AliBacklink Pro plans are billed monthly and will automatically renew every month on the same calendar day as your initial subscription purchase. The subscription fee will be automatically charged to your provided payment method at the start of each billing cycle (each, a “Subscription Period”) unless you cancel the subscription in accordance with the Cancellation terms below.

Initial Commitment Period: By subscribing to AliBacklink Pro, you agree to a minimum commitment of 30 days (one Subscription Period). Your subscription cannot be cancelled within the first 30 days of service. After this initial period, the subscription continues on a month-to-month basis.

We do not lock you into long-term contracts beyond the initial month – after the first month, you may cancel at any time with effect from the end of the then-current billing period (see Cancellation and Termination section). This policy is in line with consumer protection laws that allow customers to terminate subscriptions after the initial term with no more than one month’s notice (FCCA: Germany’s New Subscription Law). There are no annual contracts or multi-month commitments required; subscriptions are flexible and can be ended by the user on a monthly basis.

Upgrade/Downgrade: You may request to upgrade to a higher tier or downgrade to a lower tier. Upgrades will take effect immediately (with a prorated charge for the difference in price for the remainder of the current month, or starting a new billing cycle at the new rate), and downgrades will generally take effect from the next billing cycle. Please contact our support if you wish to change your plan.

Subscription Benefits: During an active subscription, you may queue new service orders up to your plan’s concurrency limit. Unused order slots do not carry over to future months – if you do not utilize your full allotment of concurrent orders in a given month, you forfeit the unused capacity for that month. Subscription fees cover the labor and resources to fulfill your ordered services each month; they do not accrue as a monetary balance or credit.

Ordering and Delivery

When you purchase a one-time service or submit an order under a subscription plan, the following process and conditions apply:

  • Placing Orders: Orders can be placed through our website by selecting the desired service and providing the required details (e.g., target website URL, keywords, or other pertinent information). You must ensure that all information you provide with an order is accurate, complete, and does not infringe any third-party rights. We reserve the right to reject or cancel an order if the provided content or target violates our policies (for example, if it involves illegal, hateful, or adult material) or for any other reasonable cause; in such case, we will notify you and issue a refund if payment was already made.

  • Payment: All orders (one-time or subscription) must be paid in advance. Prices are listed in U.S. Dollars (USD) and are exclusive of any applicable taxes or fees, unless stated otherwise. Depending on your location, VAT or other taxes may be added at checkout in accordance with applicable laws. You are responsible for any bank fees, currency exchange differences, or other charges related to the payment.

  • Delivery Timeframe: Upon successful payment and receipt of all necessary information from you, we will commence work on your order. Delivery times vary based on the service type:

    • One-Time Services: typically delivered within 7 to 14 days.

    • Subscription Services (AliBacklink Pro): each individual order under your subscription will be delivered within the timeframe specified by your plan (e.g., 7 days for Tier 1 and 2, or 3 days for Tier 3).

    Delivery timeframes are estimates and start from the time we confirm your order and have all required inputs. We strive to meet these timelines, but please note that occasional delays can occur due to unforeseen circumstances or high demand. If we anticipate a significant delay in your order, we will inform you as soon as possible and provide an updated delivery estimate.

  • Delivery Method: The results or deliverables of our Services (such as reports, lists of backlinks created, content, etc.) will be delivered electronically. We may deliver via email, through your AliBacklink account dashboard, or through other electronic means. Once we have delivered the service output to you (for example, sending you a completion email or marking the order as delivered in your account), the order will be considered fulfilled.

  • Acceptance of Deliverables: You agree to review the delivered work promptly. If you believe the delivered service does not meet the agreed description or requirements, you must notify us within 7 days of delivery, detailing the issue. We will investigate and, if appropriate, correct any deficiencies at no additional cost to you. If we do not receive any feedback within 7 days of delivery, the service will be deemed accepted.

  • User Cooperation: Timely delivery often requires your cooperation. You may need to provide us with certain access or materials (for example, if SEO work requires access to your website or if content creation needs your approval on topics). You agree to provide any required inputs in a timely manner. We are not liable for delays caused by your failure to provide necessary information or approvals.

  • Third-Party Services and Tools: In performing digital marketing services, we might utilize third-party tools or platforms (for example, analytics services, advertising platforms, or website analytics tools). We will use such tools in accordance with their terms of use and solely to benefit your marketing objectives. You acknowledge that third-party platforms are outside our control, and we cannot guarantee their performance or availability.

Refund Policy

We want you to be satisfied with our Services. However, due to the nature of digital marketing work, we have specific conditions under which refunds are granted. This Refund Policy outlines when you may be eligible for a refund and when refunds are not provided.

14-Day Statutory Right of Withdrawal (EU Customers): If you are a consumer (not a business) residing in the European Union or another jurisdiction with similar consumer protection laws, you may have the legal right to withdraw from your purchase within 14 days of the contract date (“cooling-off period”) (Guarantees, cancelling and returning your purchases – Your Europe) (Guarantees, cancelling and returning your purchases – Your Europe). This means that for 14 days after you purchase a one-time service or subscribe to AliBacklink Pro, you can cancel your order for any reason and request a full refund, provided that we have not yet begun fulfilling the service or delivered it. If you wish to exercise this right, you must inform us within the 14-day period by contacting dispute@alibacklink.com or support@alibacklink.com. We will then guide you through the withdrawal process and, if eligible, issue your refund within 14 days of your cancellation notice.

  • Exception: If you request or consent to us starting the service before the 14-day period ends and we fully deliver the service within that period, you acknowledge that you will lose your right to withdraw from the contract once the service is fully delivered (Guarantees, cancelling and returning your purchases – Your Europe). For example, if you purchase a one-time SEO service and ask us to begin immediately, and we complete the service (deliver the results) within a week, you cannot later cancel under the statutory cooling-off rule because the service was fully performed within 14 days at your request. We will typically ask for your express consent to commence work early (and acknowledgment of waiving the withdrawal right) at the time of purchase if applicable.

AliBacklink Refund Policy (Our Service Guarantee): Independently of any statutory rights, we offer the following refund promises to our customers:

  • Service Not Delivered on Time: If we fail to deliver a one-time service or a subscription order within the specified delivery timeframe (7-14 days for one-time services, or the plan-specific timeframe for subscriptions) and you prefer to cancel the order rather than continue waiting, you may request a cancellation and refund for that order. This does not apply if the delay was caused in part by your own delay in providing required information or responding to our inquiries.

  • Order Cancellation Before Work Begins: For one-time service purchases, if you change your mind after purchase and we have not yet begun substantive work on your order, you may request a cancellation and full refund. If work has already started (for example, our team has begun research, outreach, or content creation), any refund will be at our discretion. We will consider the proportion of work completed and may offer a partial refund in such cases.

  • Subscription Cancellation and Refunds: When you cancel an AliBacklink Pro subscription (after the initial 30-day minimum), your cancellation will take effect at the end of your current paid month. We generally do not provide refunds for the remainder of a billing period after a subscription is cancelled. This means if you cancel mid-month, you will retain access to your subscription features until the end of that month, but you will not receive a refund for the unused days in that month. The subscription fee for that month is only refundable if you cancel within the first 14 days and meet the conditions of the statutory withdrawal right described above, or if we have materially failed to provide the services promised during that period.

  • Unsatisfactory Service Outcomes: If you are dissatisfied with the quality of a delivered service (for example, if something was clearly not done as described in the service offering), please contact us at dispute@alibacklink.com within 14 days of delivery. We will review your concerns and attempt to remedy any issue. If we determine that the service delivered did not substantially conform to what was promised and we are unable to correct it, we may, at our discretion, issue a full or partial refund. However, dissatisfaction with intangible outcomes (for example, not achieving a certain rank or sales increase, when no specific result was guaranteed) is not grounds for a refund if the service was otherwise delivered as agreed.

  • Duplicate or Erroneous Payments: If you were charged twice or charged in error, we will refund any such overpayment. Please notify us as soon as possible if you believe you have been mistakenly charged.

No Refund Situations: We will not issue refunds in the following cases:

  • If the service deliverables have been provided as described and the service was rendered in full, a change of mind or unhappiness with general results will not qualify for a refund (outside of applicable legal rights).

  • If you violate these Terms or misuse the Services, and as a result we terminate your account or order, you will not be entitled to a refund for Services already delivered or in progress.

  • Failure to utilize the Services or forgetting to cancel a subscription does not entitle you to a refund. (For example, if you subscribe to AliBacklink Pro but do not submit any orders during a month, you are still responsible for that month’s payment; we encourage you to make use of the Services you have paid for.)

  • Requests for refunds made beyond the time frames specified above (such as significantly after delivery) may not be honored.

Refund Process: To request a refund, contact us at dispute@alibacklink.com with your order details and the reason for the request. We may require additional information to evaluate your request. If a refund is approved, we will issue the refund to the original payment method used for the purchase. Please allow a reasonable time for the refund to process through your bank or payment provider.

This Refund Policy does not affect any rights you have under law. In the event of any inconsistency between this policy and your statutory rights (for example, rights under consumer protection laws), your statutory rights will prevail.


Data Collection and Privacy

Your privacy is important to us. When you use AliBacklink, we collect and process certain personal data from you in order to provide our Services effectively and comply with legal requirements. Our data collection and use practices are described in detail in our Privacy Policy, which is hereby incorporated into these Terms by reference. By agreeing to these Terms and using our Services, you also agree to the terms of our Privacy Policy (Terms and Conditions – GDPR.eu).

Personal Data Collected: The types of personal information we may collect include, for example:

  • Your name, email address, and phone number (especially during account registration or when placing orders).

  • Billing information (such as payment method details) – note that for security, we may use third-party payment processors, so we might not store full payment card numbers on our systems.

  • Your company name (if provided), and general location information such as country or address for billing (to calculate taxes or comply with invoicing laws).

  • Any information you voluntarily provide to us when communicating with support or filling out order instructions (which could include details about your website, marketing targets, etc.).

We collect and use this information solely for legitimate business purposes, including: providing and delivering the Services to you, communicating with you about your orders or inquiries, personalizing the service, and improving our offerings. We may also use your contact information to send you service-related announcements or promotional offers, but you can opt out of marketing communications at any time.

GDPR Compliance: For users in the European Union (and EEA), we process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable German data protection laws. AliBacklink acts as the “data controller” for the personal information you provide to us, meaning we determine the purposes and means of processing that data. We rely on various legal bases to process data: for example, processing that is necessary to perform our contract with you (such as using your email to send deliverables), compliance with our legal obligations, and our legitimate interests in providing and improving our Services. Where we rely on consent (such as for certain marketing emails), we will explicitly seek it.

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, or misuse. However, no method of transmission over the Internet or electronic storage is 100% secure, so we cannot guarantee absolute security of your data.

User Rights: You have rights regarding your personal data. Subject to applicable law, you may have the right to request access to the data we hold about you, correct any inaccuracies, or request deletion of your data. You may also object to or restrict certain processing of your data, or request a portable copy of the data. To exercise any of these rights, please contact us at privacy@alibacklink.com (or dispute@alibacklink.com). We will respond in accordance with applicable law. If you are an EU resident, you also have the right to lodge a complaint with your local data protection authority if you believe your data has been handled improperly.

Data Sharing and International Transfers: AliBacklink will not sell your personal information to third parties. We only share your data with third parties in a few situations:

  • With service providers who help us run our business (for example, payment processors, IT infrastructure providers, email service providers) — in such cases, these parties are bound by confidentiality and data protection obligations and will only use the data as instructed by us.

  • If required by law or lawful request by public authorities (e.g., to comply with a subpoena or similar legal process).

  • If necessary to enforce our Terms or protect our rights, property, or safety, or that of our users or others (for example, to prevent fraud or abuse of our Services).

Given that we serve customers worldwide, your data may be processed on servers located in countries outside of your home country. If you are in the EU, note that your personal data might be transferred to countries outside the European Economic Area. In such cases, we will ensure that appropriate safeguards are in place to comply with GDPR requirements for cross-border data transfer (for example, using EU Commission-approved standard contractual clauses, or transferring to jurisdictions deemed “adequate” by the EU).

For more information, please review our Privacy Policy. Using our Services signifies your acceptance of how we collect and use your data as described herein and in our Privacy Policy. (Privacy policies are required by data protection regulations like the GDPR (Privacy Policy vs. Terms and Conditions – Termly), and we strive to be transparent about our practices.)

Cancellation and Termination

Cancellation by User (Subscription Services): You may cancel your AliBacklink Pro subscription at any time after the first 30 days. Cancellation can be done through your account settings on our website or by contacting our support team. If you cancel, your subscription will remain active until the end of the current monthly billing cycle and will not be renewed thereafter. You will not be charged for any month following the month in which you cancel. (For example, if your billing cycle is on the 15th of each month and you cancel on June 20th, your subscription will remain active until July 15th, but not renew after that date.) We do not offer prorated refunds for partial months of service after cancellation, except as required by law or explicitly provided in our Refund Policy above.

We are required by German law to ensure that subscription cancellations are easy to perform and do not impose unnecessary hurdles. Therefore, if you subscribed online, you will find a simple online cancellation method (a “cancel subscription” option in your account portal) in compliance with cancellation button requirements under German law (FCCA: Germany’s New Subscription Law). You may also cancel by emailing us at support@alibacklink.com or dispute@alibacklink.com with a clear request to cancel.

Termination by AliBacklink: We reserve the right to suspend or terminate your access to the Services (including any active orders or subscriptions) at our discretion if:

  • You breach any of these Terms in a serious or persistent way (for example, failure to pay fees when due, misuse of our Services for unlawful purposes, or infringement of intellectual property rights);

  • We are required to do so to comply with a legal requirement or court order;

  • We discontinue the Services or any portion thereof (if, for example, we decide to cease offering AliBacklink Pro subscriptions, we will give you advance notice and refund any prepaid fees for the remainder of your subscription period);

  • There is an unexpected technical or security issue or problem.

If we terminate your account or subscription due to a breach of the Terms or misconduct by you, you will not be entitled to any refunds for services already paid (including for the remaining period of a subscription, if any). If we terminate or discontinue the Service for convenience and not due to your fault, we will refund any amounts you have paid for services not yet rendered.

Upon termination or expiration of your subscription, your right to access subscriber features will cease at the end of the paid period. If you had an account with us, we may disable or delete it. You should download or save any deliverables or reports we have provided to you prior to the end of your access. We may retain certain information as required by law or as necessary for our legitimate business purposes (such as maintaining records of transactions).

Effect of Termination: Any provisions of these Terms which by their nature should survive termination (such as intellectual property provisions, disclaimer of warranties, limitation of liability, dispute resolution, and governing law) will survive. Termination of the agreement does not relieve you of any obligation to pay any outstanding fees owed up to the date of termination.

Dispute Resolution

We hope to resolve any issues or disputes amicably through our support team. If you have a dispute or any dissatisfaction with the Services, you agree to first notify us and attempt to resolve the issue by contacting our disputes department at dispute@alibacklink.com. Please provide all relevant information, such as the order number, the nature of the dispute, and any supporting documentation. We will acknowledge receipt of your dispute and aim to respond with a proposed solution or request for more information within 10 business days.

If we are unable to resolve the dispute through our internal support process, the following terms will apply:

  • Good Faith Negotiation: Both you and AliBacklink agree to attempt in good faith to resolve any dispute or claim arising out of or in connection with these Terms or the Services through negotiation before pursuing other remedies.

  • No Class Actions: You and AliBacklink each agree that any disputes will be resolved on an individual basis, and that no party will join or consolidate claims by or against others in any lawsuit or arbitration or otherwise pursue any claim as a class action or representative proceeding. (This clause may not apply if prohibited by applicable law; if you are a consumer in certain jurisdictions, you may have the right to bring a claim in a collective proceeding. This term does not waive any of your non-waivable rights.)

  • Available Legal Remedies: If the dispute cannot be resolved amicably, either party may seek relief through competent courts as described in the Legal Jurisdiction section below. We do not currently require arbitration or any alternative dispute resolution mechanism as mandatory, but we remain open to the possibility of mutually agreeing to mediation or arbitration for individual disputes if both parties find it suitable.

For customers in the European Union, you also have the option to use the EU Online Dispute Resolution (ODR) platform to facilitate resolution of disputes (especially those related to online sales and services). The ODR platform can be found at https://ec.europa.eu/consumers/odr. This is an optional resource; we encourage you to contact us directly first.

Legal Jurisdiction

These Terms of Service and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles. However, if you are a consumer resident outside of Germany, you may also be entitled to the protection of the mandatory consumer protection laws of your country of residence; nothing in these Terms reduces your rights under such laws where they apply.

In the event of any dispute between us that proceeds to formal legal action, such dispute shall be brought before the courts of Germany, and specifically the competent courts located in Berlin, Germany, unless applicable law in your jurisdiction requires that disputes be resolved in your home country. Both you and AliBacklink agree to submit to the personal jurisdiction of the courts in Berlin, Germany for the purpose of litigating all such disputes.

Notwithstanding the foregoing, we reserve the right to seek injunctive relief or enforcement of judgments in any appropriate jurisdiction.

Disclaimer of Warranties

Except as explicitly provided in these Terms or as required by law, the Services are provided “as is” and “as available.” AliBacklink disclaims all warranties of any kind, whether express or implied, statutory or otherwise, including but not limited to any warranties of merchantability, fitness for a particular purpose, and non-infringement (Terms of Service | Marketing 360®). We do not guarantee that the Services will meet your specific requirements, achieve any particular outcome, or be uninterrupted, error-free, or secure. Any information or advice obtained from AliBacklink outside of these Terms (for example, tips or best practices) does not create any warranty not expressly stated herein.

You understand that digital marketing inherently involves uncertainty and that past results do not guarantee future performance. AliBacklink does not warrant or make any representation that the deliverables or results of the Services will be successful for your purposes or will yield any specific return on investment. You use the deliverables and recommendations we provide at your own risk.

To the extent that AliBacklink may not disclaim a warranty as a matter of applicable law (for instance, because of legal protections for consumers), the scope and duration of such warranty will be the minimum permitted under such law.

Limitation of Liability

To the maximum extent permitted by law, in no event shall AliBacklink or its owners, employees, agents, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenues, business opportunities, goodwill, or data, arising out of or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages (Terms of Service | Marketing 360®). This limitation applies to all causes of action, whether in contract, tort (including negligence), strict liability, or any other legal theory.

To the maximum extent permitted by law, AliBacklink’s total cumulative liability for all claims arising from or related to the Services or these Terms will not exceed the total amount of fees you have paid us in the 12 months preceding the event giving rise to the liability (Terms of Service | Marketing 360®). If you have not paid any fees (for example, if you merely visited our website without purchasing anything), then AliBacklink shall have no liability to you, to the extent allowed by law.

Exceptions: Nothing in these Terms is intended to exclude or limit liability that cannot be excluded under law. This includes, for example, liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation. Additionally, because some jurisdictions do not allow the exclusion of certain warranties or the limitation/exclusion of liability for certain types of damages, some of the above disclaimers and limitations may not apply to you. In such jurisdictions, AliBacklink’s liability will be limited to the fullest extent permitted by applicable law.

You acknowledge that the fees paid reflect the allocation of risk set forth in these Terms and that AliBacklink would not be able to offer the Services on an economically feasible basis without such limitations.

Changes to Terms

We may revise or update these Terms of Service from time to time. If we make material changes, we will provide you with notice as appropriate (for example, by email to registered users or by placing a prominent notice on our website) prior to the change becoming effective. The latest version of the Terms will always be available on our website, and we will indicate the date of the last update at the top of the Terms.

Your continued use of the Services after any changes to the Terms become effective constitutes your acceptance of the revised Terms (Terms and Conditions – GDPR.eu). If you do not agree with the updated Terms, you must stop using the Services and, if applicable, cancel your subscription or account before the new Terms apply. Within the limits of applicable law, we reserve the right to determine the appropriate method and scope of notice for changes and the right to make minor changes that do not materially affect your rights without specific notice beyond posting the updated Terms.
